Constitutional Court confirms that Kampala city is still a district, not a capital city
The Justices said that since after the amendment Kampala maintained its constituencies, ''it is clear that the capital City status was meant to offer administrative services but not to abolish it as a district''

The Constitutional Court has today ruled that Kampala City is still a district despite constitutional amendments that elevated it to capital city status.

 

In the unanimous judgement of Justices; Steven Kavuma, Richard Buteera, Solomy Bossa, Cheborion Barishaki and Paul Mugamba, also upheld the election of FDC's Nabilah Naggayi Ssempala as the Kampala district woman MP.

 

According to the Justices of the constitutional court, the constitutional amendments that elevated Kampala to the status of a Capital city were just descriptive in nature and did not have an effect on its administrative structures henceforth its residents must enjoy equal representation in Parliament by electing people to occupy all elective posts.

 

The Justices said that since after the amendment Kampala maintained its constituencies, ''it is clear that the capital City status was meant to offer administrative services but not to abolish it as a district''

 

In the judgement read to court by the deputy registrar Taddeo Asiimwe, the justices also re-echoed the State's core motive behind creating elective posts of  district women representatives in parliament as being able to  address questions of gender inquality by then, hencefourth court cannot  be seen denying Kampala residents that opportunity.

 

The ruling follows a Constitutional petition filed by a one Alex Odonga; a concerned Kampala voter who asked the Constitutional court to nullify the election of Nabilah Nagayi Ssempala as the Kampala district woman MP on grounds that Kampala assumed the status of a city where her post is not provided for as is the case in  other cities and municipalities.

 

However constitutional court dismissed his petition and confirmed Kampala city as a District.  Court has made no orders to costs
