Kooki county MP Boaz Kasirabo retains seat on appeal
Three justices- retired Deputy Chief Justice Stephen Kavuma, Cheborion Barishaki and Elizabeth Musoke overturned the decision of Masaka High court which had nullified Boaz Kasirabo's election on grounds of electoral fraud.

Three justices- retired Deputy Chief Justice Stephen Kavuma, Cheborion Barishaki and Elizabeth Musoke overturned the decision of Masaka High court which had nullified Boaz  Kasirabo's election on grounds of electoral fraud.

Kasirabo was dissatisfied with this decision and had petitioned the court of appeal.

The court of appeal chastised High court judge Margaret Tibulya for failing to apply the required standard in evaluating evidence on the election petition and arriving at her conclusion, basing on collaborated evidence of partisan witnesses.

They have ruled that Kasirabo's rival David Mpuuga did not prove the alleged electoral malpractices of ballot -stuffing, multiple voting and intimidation of voters by the UPDF to the court's satisfaction.

The court has now set aside the lower court's judgement and confirmed Kasirabo  MP with orders that Mpuuga pays him costs of this petition both in the High court and court of Appeal.
